What Are the Most Common Defenses Against Broken Bone Claims?
We see the same defenses again and again. Some of the most common assertions are:
- The accident was partly or fully your fault.
- You missed the statute of limitations deadline (generally, two years from the date of the accident).
- The defendant is not the party that caused the accident.
- Your damages are not as serious as you are claiming.

How Does Comparative Fault Work in Georgia?Under Georgia’s comparative fault system, known as Modified Comparative Fault with a 50 Percent Bar, you can still receive compensation for a broken bone accident even if the accident was partly your fault, as long as your fault was less than the fault of the defendant’s fault. If the accident was partly your fault, however, your compensation will be reduced.
